In an era where digital platforms serve as the modern public square, the suppression of speech—especially political speech critical of the government—poses a grave threat to democracy and constitutional liberty. Just recently, after I posted a public criticism on X (formerly Twitter) tagging National Security Advisor @MikeWaltz47, I received a notice that my account had been flagged for possible "spam or platform manipulation." My account was suddenly shadow banned—my posts were limited in reach, hidden from replies, trends, and recommendations. This occurred within just a few hours of my criticism. I am not saying for sure that the government is involved.
However, This does not seem like merely a case of algorithmic quirk or accidental moderation. If it is revealed that the government or Representative #mikewaltz pressured X to suppress my content for criticizing national security decisions or public officials, that constitutes a direct violation of my First Amendment rights. And I assure you—I am not the average user. I am a different breed. I am a Biblical, Section 1983, and Constitutional scholar for decades who has studied these issues for over 28 years. I know my rights, and I will defend them.
The Constitutional Violation: The First Amendment
The First Amendment of the United States Constitution prohibits the government from "abridging the freedom of speech." This protection does not disappear in the digital realm. While private companies like X are not directly bound by the First Amendment, if the government induces, pressures, or colludes with a platform to silence a citizen’s speech, that constitutes state action and is unconstitutional.
This principle was affirmed in ongoing litigation such as Murthy v. Missouri, where federal courts found substantial evidence that the Biden White House, CDC, FBI, and other agencies pressured social media companies to suppress disfavored viewpoints, particularly on COVID-19. That form of coercion, regardless of intent, violates the First Amendment.
Federal Statutes Potentially Violated
If any government official or agency was involved in the suppression of my post or pressured X to shadow ban me, the following federal laws may have been violated:
1. 42 U.S. Code § 1983 – Civil Action for Deprivation of Rights
This statute allows individuals to sue any person acting "under color of law" who deprives them of constitutional rights. If any government actor collaborated with X to censor my lawful speech, they may be liable under Section 1983.
2. 18 U.S. Code § 242 – Deprivation of Rights Under Color of Law (Criminal)
This federal criminal statute makes it illegal for anyone acting under the color of law to willfully deprive a person of any rights protected by the Constitution.
3. 18 U.S. Code § 241 – Conspiracy Against Rights
If two or more persons conspired to injure, oppress, threaten, or intimidate me in the free exercise of my First Amendment rights, they may be criminally liable under this law.
4. CIA and Intelligence Restrictions (National Security Act of 1947)
The CIA and other intelligence agencies are prohibited from conducting domestic operations targeting U.S. citizens. If any such agency was involved in flagging my content through backchannels, they may be in violation of this federal charter.
5. Abuse of Power / Official Oppression
These are legal doctrines, often codified at the state level, that prohibit officials from using their position to harm citizens for exercising their rights. In states like Texas, for instance, "official oppression" is a crime when a public servant intentionally subjects another to mistreatment for exercising a right.
Pattern of Government-Corporate Collusion
We have seen this pattern before:
-The Biden White House pressured Facebook to remove posts questioning COVID-19 vaccines.
-The Twitter Files, released under Elon Musk, revealed how FBI and DHS routinely sent takedown requests to Twitter before Musk took over.
-In Murthy v. Missouri, courts found that multiple federal agencies likely violated the Constitution by coercing platforms to suppress disfavored opinions.
This is not a "conspiracy theory." It is public record, confirmed in federal court.
If it is found that National Security Advisor Mike Waltz, his office, or any federal agency acted in a similar manner toward my account, then this case will stand alongside those of national importance.
Potential for RICO Charges?
If multiple government officials or agencies worked together with or through private actors (like social media execs or cybersecurity contractors) to suppress speech unlawfully, that may constitute a pattern of racketeering activity under the Racketeer Influenced and Corrupt Organizations Act (RICO).
-18 U.S. Code § 1962 prohibits any person associated with an enterprise from conducting its affairs through a pattern of racketeering activity.
-If unlawful censorship was coordinated, deliberate, and repetitive, and done under false pretenses or through fraud, a civil RICO case may be brought.
My Next Steps
Let me be clear: I am not afraid. I am LEGALLY prepared. If this shadow banning persists, or if further evidence comes to light indicating that a government actor was involved:
1. I will file a FOIA (Freedom of Information Act) request with the relevant federal agencies (e.g., DHS, FBI, NSA, and NSA Waltz’s office) to determine whether my account was flagged due to government communication.
2. I will retain counsel and pursue a Bivens lawsuit against every government actor involved, in both individual and official capacities.
3. I will pursue punitive damages, compensatory damages, and injunctive relief.
4. If multiple actors are involved, I will consult legal experts on the possibility of civil RICO charges.
A Respectful but Firm Warning
I voted for @realDonaldTrump and I pray for the Trump administration EVERY SINGLE NIGHT WITHOUT FAIL. This is not a threat. This is a respectful but firm assertion of my constitutional rights. I will not sit idly by while my voice is suppressed for asking hard questions or criticizing those in power such as NSA Mike Waltz who I am certain that the Lord Jesus Christ does not agree with. That is exactly what the First Amendment was created to protect.
This is bigger than me. This is about the precedent being set for every American who dares to speak the truth in an age of manufactured consent and algorithmic silencing.
To the officials who may be involved: Do not underestimate the resolve of an informed citizen, let alone a Civil rights activist who has litigated these statutes for years.
If it can be proven that you used your office to silence dissent, not only will you be held accountable in court—you will also be held accountable in the court of public opinion.
I am a Biblical, Section 1983, and Constitutional scholar. I am a peaceful God fearing person, but when illegally attacked I understand that a "Civil Action" is the alternative to violence, so I use it. Legally speaking only, I do not back down. I do not go away. I go deeper, I research harder, and I will pursue every legal means available to defend the freedoms that countless others fought and died for. Having said that, this administration has created enough problems for itself and I would rather not have to pursue legal action. Proverbs says a wise person accepts correction and reproof. "

As A Watchman for the Lord Jesus Christ I do not sharply criticize to simply condemn, but to save your lives and you are always welcome to repent and surrender to the Lord Jesus Christ. I care about everyone I criticize and am trying to turn you all from the error of your ways and I have removed the beam from my own eye and am qualified to correct you. So please, don't retaliate against me. Ask me for spiritual advice, or just let me exercise my rights please.
